Please read these Terms and Conditions ('Terms') carefully before registering for or attending any workshop, class, or event offered by The Jeweler's Shop LLC, doing business as The Jeweler's Workshop ('we,' 'us,' or 'our'). By booking a workshop, making a payment, or accessing our website, you ('you' or 'Participant') agree to be bound by these Terms. If you do not agree, please do not register for or attend our workshops.
1. Acceptance of Terms
By registering for a workshop through our website or any other booking channel, you confirm that you have read, understood, and agree to these Terms, including our Cancellation and Refund Policy and our Participant Safety and Liability provisions. These Terms constitute a legally binding agreement between you and The Jeweler's Workshop.
2. Workshop Registration and Booking
2.1 Eligibility
Workshops are open to participants aged 10 and older. Participants under the age of 18 may attend only when accompanied by a registered adult guardian (18+) who assumes full responsibility for the minor's participation and safety throughout the entire workshop. The adult guardian must be present for the duration of the class and must also agree to these Terms on behalf of the minor. Children under the age of 10 may not attend workshops under any circumstances.
2.2 Registration Process
Registration is completed online through our website and is confirmed only upon receipt of full or required deposit payment. Seats are limited and registration is first-come, first-served. Your spot is not guaranteed until payment is processed and a confirmation is issued to you.
2.3 Accuracy of Information
You agree to provide accurate, current, and complete information during registration. We are not responsible for booking errors, missed confirmations, or workshop issues arising from incorrect information provided by you.
3. Payment Terms
3.1 Accepted Payment Methods
All workshop fees are payable online via credit card or debit card at the time of registration. We use a secure third-party payment processor. The Jeweler's Workshop does not store your full card details on our servers.
3.2 Pricing
All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price in effect at the time of your registration confirmation applies to your booking. Some workshops may include material fees; any such fees will be disclosed at the time of booking.
3.3 Failed Payments
If your payment is declined or reversed for any reason, your registration will not be confirmed and your spot may be released. You are responsible for ensuring that your payment is successfully processed.
4. Cancellation and Refund Policy
We understand that plans change. Our cancellation policy is as follows:
• 72 or more hours before your workshop: No charge. You may cancel or reschedule your booking with no penalty. Simply reach out to us and we will take care of it.
• Within 72 hours of your workshop: A late cancellation fee of $45 applies per reserved seat. Because your seat has been held and is unlikely to be filled at short notice, this fee helps us offset the reserved resources and instructor preparation.
• Within 24 hours of your workshop or no-shows: The full workshop fee applies for each reserved seat. No refund will be issued.
All cancellation and reschedule requests must be submitted in writing by emailing hello@thejewelersworkshop.net. The date and time of receipt of your written request will determine which policy tier applies.
4.1 Workshop Cancellation by The Jeweler's Workshop
We reserve the right to cancel or reschedule any workshop due to insufficient enrollment, instructor unavailability, facility issues, unsafe conditions, or other circumstances beyond our reasonable control. In the event of a cancellation by us, you will receive a full refund of any fees paid, or the option to transfer your registration to a rescheduled date. We are not responsible for any ancillary costs you may have incurred (such as travel or accommodation).
5. Participant Conduct and Studio Rules
To ensure a safe and enjoyable experience for all, participants agree to:
• Follow all verbal and written instructions provided by instructors and staff at all times.
• Wear appropriate attire as advised. Open-toed shoes, loose sleeves, and dangling jewelry are prohibited during hands-on silversmithing activities.
• Refrain from using tools, equipment, or materials in any manner not expressly instructed.
• Supervise minors in their care at all times and ensure minors comply with all studio rules.
• Refrain from attending if under the influence of alcohol, drugs, or any substance that may impair judgment or coordination.
• Treat fellow participants, instructors, and studio property with respect.
We reserve the right to remove any participant, without refund, who fails to comply with studio rules, poses a safety risk, or engages in disruptive or disrespectful conduct.
6. Health, Safety, and Assumption of Risk
Silversmithing and silver clay work involve the use of tools, torches, chemicals, and heat-producing equipment. These activities carry inherent risks, including but not limited to burns, cuts, allergic reactions, and exposure to fumes. By registering and attending a workshop, you voluntarily and knowingly assume all such risks associated with participation.
You acknowledge that The Jeweler's Workshop has implemented reasonable safety measures and that our instructors will provide safety guidance. You agree to follow all safety instructions at all times.
Participants with known allergies to silver, metal compounds, or workshop materials, or with health conditions that may be aggravated by workshop activities, should consult with a physician prior to registration and disclose any relevant information to us in advance.
7. Limitation of Liability and Waiver
To the fullest extent permitted by applicable law, The Jeweler's Workshop, its owners, instructors, employees, and agents shall not be liable for any personal injury, property damage, loss, or any other claim arising from or related to participation in our workshops, except in cases of gross negligence or willful misconduct on our part.
By registering, you waive any and all claims against The Jeweler's Workshop for injury, loss, or damages arising from your participation. This waiver extends to any minor for whom you are registering as a supervising adult guardian.
In no event shall our total liability to you exceed the total amount paid by you for the specific workshop giving rise to the claim.
8. Intellectual Property
All course materials, instructional content, techniques, designs, and workshop content provided by The Jeweler's Workshop are the proprietary intellectual property of The Jeweler's Workshop. You may not reproduce, distribute, sell, or create derivative works from our instructional content without our prior written consent.
You retain ownership of any physical pieces you create during a workshop. However, by participating, you grant The Jeweler's Workshop a non-exclusive, royalty-free license to photograph your finished work and use such images for marketing, educational, and promotional purposes. If you do not wish your work to be photographed, please notify us in writing prior to the workshop.
9. Photography and Media Release
Workshops may be photographed or recorded for promotional and educational purposes. By participating, you consent to The Jeweler's Workshop capturing your likeness and any work you create, and using such content across our website, social media, and marketing materials. If you do not consent, please notify us in writing before the workshop date.
10. Website Use
Use of our website is subject to these Terms. You agree not to misuse the website, attempt to gain unauthorized access to any system, transmit harmful or unlawful content, or engage in any conduct that disrupts the normal functioning of the website. We reserve the right to suspend access to our website at any time and for any reason.
11. Privacy Policy
Your personal information collected through registration and payment is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We collect and use your information solely for the purpose of processing registrations, communicating about workshops, and complying with applicable laws. We do not sell your personal information to third parties.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, and the arbitration shall take place in Brevard County, Florida.
Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction where necessary to protect immediate rights.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. The revised Terms will be posted on our website with an updated Effective Date. Continued use of our website or registration for workshops after the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any workshop-specific policies communicated at the time of registration, constitute the entire agreement between you and The Jeweler's Workshop regarding your participation in our workshops and use of our website. They supersede all prior understandings, representations, or agreements.
